ReWatt, Inc. d/b/a RealSynch (”RealSynch” or “We”) respects your privacy and are committed to protecting it through our compliance with this ”Policy”.

This Policy describes the types of Personal Information and data that RealSynch may collect from you and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies to information we collect:

  • when you access our website located at https://realsynch.com (the “Site”) or the RealSynch data and application integration platform accessible through the Site or any downloadable desktop or mobile applications we may offer (the “Platform” and, together with the Site, the “Service”);
  • we provide services to you in connection with the Platform under an agreement with you;
  • in e-mail, text, and other electronic messages between sent or received by you via the Site or the Platform; and
  • when you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.
  • This Policy does not apply to information collected:

  • by us offline or through any other means, including on any other website or application operated by RealSynch or any third party; or
  • by any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Site or Platform.

Acceptance of this Policy

By using Our Site or Platform (whether or not you register or create any kind of account with us), you accept the terms set forth in this Privacy Policy.  Anyone that does not agree to the terms of this Privacy Policy should not use our Site or Platform. The only recourse for users that do not agree to the terms of this Privacy Policy shall be to discontinue visiting our Site and using our Platform. By visiting our Site or using our Platform, you consent to having your Personal Information transferred to and processed by RealSynch and our consultants, service providers, and business partners in the manner described in this Policy.

This Policy may change from time to time (see “Changes to Our Privacy Policy” below). Your continued use of this Site after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

Children

Our Site is not intended for children under 16 years of age. We do not knowingly collect Personal Information from children under 16, and no one under age 16 may provide any information on the Site or Platform. If you are under 16, do not use or provide any information on the Site or Platform or through any of their features, register on the Site or Platform, make any purchases through the Site or Platform, or otherwise provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us at privacy@realsynch.com. California residents under 16 years of age may have additional rights regarding the collection and sale of their Personal Information. Please see “Your State Privacy Rights” below for more information.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Site and Platform, including information by which you may be personally identified, such as your name, postal address, e-mail address, telephone number, payment information, any other identifier through which, alone or in the aggregate, you may be individually identified (”Personal Information”); that is about you but individually does not identify you, such as your company/employer name, size of your team, number of transactions annually, CRM data, and transaction lead information; and about your internet connection, the equipment you use to access our Site or use our Platform, and usage details.

We collect this information directly from you; automatically through your visits to our Site and use of our Platform; from certain third parties in connection with your access to and use of the Site and Platform; when you request quotes, services, support, downloads, trials, whitepapers, training or information; place orders for our products or services; when you create and manage an account on our Site or Platform; when you subscribe to newsletters, marketing and promotional emails or other materials; when you interact with us on third-party social networks (subject to that third party’s terms of use and privacy policies); and when you contact us. We may combine information obtained from or about you through any of these various sources. In order to better help you understand the types of data we collect from you, we’ve broken down the categories of collected data below.

Information About You that We Collect Directly From You

Most of the information about you that we may collect will be collected directly from you, as described below. Forms that you choose to complete will indicate whether information requested is mandatory or voluntary.

  • Contact information. You can opt to receive e-mail updates and newsletters from us by filling out our contact form or support form or through the Chat feature on our Site, which may require you to provide us with your name and e-mail address and, if applicable, your customer account username.
  • Account information. You do not need to create an account to access certain features of the Site. In order to access the Platform and use certain other features of our Site or Platform, however, you must first create a RealSynch account. When you create or update your account, you will be required to provide us with your name, e-mail address, and phone number, and you will choose a unique username.
  • Profile information. Users of the Platform may have the ability to create a personal profile by providing us with certain data, including your name, mailing address, phone number, and e-mail address, and to upload a photo of yourself.
  • Third-party account information. We provide you with the ability to link your RealSynch account to certain of your accounts with third-party platforms, for example, in order to log in to your RealSynch account using your Facebook or Google login credentials. In this case, we will require your permission to access certain information about you that is stored in that third-party account. The information we receive will depend upon what information that you or the third-party platform choose to provide to us, and may include your name, profile picture, username, login e-mail address, location, physical location of your access device, gender, date of birth, and list of friends or contacts stored in your account with that third-party platform.
  • Payment information. You will be required to provide us with certain information relating to the payment method you choose to use to make such purchases. The majority of your payment information is stored with our third-party payment processor, but we do receive and store some of this information, including your customer ID and account ID with the third-party payment processor, the transaction ID, the amount charged, your receipt, the type of credit/debit card used, your card’s expiration date, the last four digits of your card, and the status of the transaction.   • Support, inquiry and feedback information. When you contact us to request support or report an issue with the Site or Platform, or to otherwise provide us with feedback or other comments regarding the Site or Platform, regardless of whether you have created an account, we will collect and store your contact information, the message, content and other data about you, such as your name and email address and any other data that you provide or that we collect through automated means (see “Information About You Collected Automatically Through the Service” below). We use this information in order to process and respond to provide you with the requested support, to respond to your inquiry, and to address your feedback.
  • Service-related information. We may collect certain information, including certain Personal Information, from you that you provide directly through the Platform as part of the services RealSynch provides to you under a customer account, including real estate lead data and related contact details.
  • Notification information. We may send periodic e-mails to you, including newsletters, promotional e-mails, updates regarding our Services or your account, and requests for feedback or assessment. (To understand your options regarding opting out of these e-mails, see “Opting Out of E-Mail Communications” below.) If you have consented to receive text/SMS notifications, we will also send you alerts and notifications related to the Services via this method.   • Published information: Certain features of the Site or Platform may provide you with the ability to create individual posts for publication on the Site or otherwise in connection with the Platform or RealSynch’s other products and services, such as customer reviews or written testimonials, video testimonials submitted by users or recorded during onboarding or demos, and quotes and success stories that you willingly share with us for marketing purposes.

Information About You Collected Automatically Through Data Collection Technologies

As you navigate through and interact with our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including your IP address, geolocation (if enabled), device type, browser type and version, operating system, any links you click on via the Site, the dates and times you access the Site, the referral source, the duration of your visits, your page views and website navigation paths, as well as other information about the timing, frequency and pattern of your visits to the Site. We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). We do not currently respond to any web browser signals or other “Do Not Track” mechanisms that enable consumers to exercise choice about behavioral tracking. The information we collect automatically may include Personal Information, or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. Our collection of this information helps us to improve our Site and to deliver a better and more personalized service, including by enabling us to improve the services we offer via the Site and Platform, including by:

  • estimating our audience size and usage patterns;
  • storing information about your preferences, allowing us to customize our Site and the Platform according to your individual interests;
  • speeding up your searches;
  • recognizing you when you return to our Site.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Site. For more information, see our Cookie Policy.
  • Web Beacons. Pages of our Site and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an e-mail and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
  • Flash Cookies. Certain features of our Site may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Site. Flash cookies are not managed by the same browser settings as are used for browser cookies. For more information, see our Cookie Policy.

We do not collect Personal Information automatically, but we may tie this information to Personal Information about you that we collect from other sources or that you provide to us (for example, when you create an account to use our Platform).

Additionally, third parties (such as our service providers and business partners) may use cookies, alone or in conjunction with web beacons or other tracking technologies, to collect information about you when you use our Site or Platform. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. For information about how you can opt out of receiving targeted advertising from certain providers, see “Opting Out of Targeted Advertising” below.

Information About You that We Receive from Others 

We may also collect information about you from other parties, including your employer under whose customer account you are accessing the Platform, the admin user managing the customer account through which you are accessing the Platform, our service providers, advertisers, ad networks and servers, content providers, and third-party application providers, and from publicly available sources, such as public posts on social media platforms and information about Internet Service Providers (ISPs) used by subscribing users to access the Platform and public databases associating IP addresses with ISPs.

We may also receive certain information about you, which may include your Personal Information, from the providers of third-party APIs that you have chosen to integrate with via the Platform (e.g., CRM platforms, Zapier, Mailparser, QuickBooks). This information includes lead data (including contact details, source, status, and conversion metrics); CRM records synced through API integrations (e.g., follow-up activity, appointments, notes); financial data from QuickBooks or other integrations (e.g., commissions, expenses, revenue tracking); data parsed through third-party tools such as Zapier and Mailparser (e.g., lead form entries, email-parsed data fields); and other data regarding your activity within the Platform.

Information We Process on Behalf of Our Customers and Users on the Platform

In the course of using our products and services, RealSynch customers and their end users may choose to integrate data that contains personal data of their individual clients and customers. The information our customers and their end-users integrate through the Platform and related services we provide is processed by RealSynch purely on behalf of the customer at the customer’s sole discretion and direction. RealSynch’s privacy practices for these instances of processing will be governed by the contract that we have in place with our customers, and not by this Policy.

RealSynch has no direct relationship with the individuals whose personal data it processes through our Platform. If you have any questions or concerns about how such information is handled or would like to exercise your rights with respect to such data, you should in the first instance contact the person or entity (i.e., the data controller) who has contracted with RealSynch to use Platform to host or process this information (e.g., your employer or real estate agent). They control the Personal Information in these cases and determine the security settings within their customer account. We will, however, provide assistance to our customers to address any concerns you may have or requests you make, in accordance with the terms of our contract with them.

Location and Geolocation Information

We may infer certain information about your location from the information that you provide to us directly or from the IP address you use to access the Site or our Platform. We may also obtain geolocation information about you (e.g., through a third-party application that tracks GPS coordinates). We use geolocation information for such purposes as improving the quality and features of the Site and our Platform in your area. You can disable our access to your geolocation services by disabling location sharing in your browser or device settings. Doing so, however, may limit your ability to access or use certain features of the Site or our Platform.

How We Use Your Information

If you provide Personal Information to us for certain specified purposes, we will use that information only for those purposes. We may use other information we collect from you for the following purposes:

Providing and Improving Our Site and Services: to provide and maintain the Site and Platform; to improve the services we provide through the Platform; to develop new features, products, or services; to perform technical operations; to deliver accurate ROI tracking, agent performance insights, and profitability analytics; to sync, structure, and normalize data across multiple platforms for clear, centralized reporting; to support automation and lead ingestion via integrations such as Zapier and Mailparser; to ensure data integrity, security, and system reliability; to provide user support, onboarding services, and maintain operational continuity; and for other customer service and support purposes.

Communications with you: to communicate with you regarding your account or your use of the Service, including to respond to your inquiries or requests; to provide you with notices about your Platform account or subscription, including expiration and renewal notices; to provide you with news and newsletters, and other information that we think may interest you; and for other informational, marketing, or promotional purposes. Our communications with you may include communications via e-mail. Please see “Opting Out of E-Mail Communications” below for more information about how to change your communications preferences.

Promotional and marketing purposes: to promote and educate others regarding the Platform and RealSynch’s other products and services and to inform prospective users of the value of the Platform and RealSynch’s technology through real customer experiences, including by publishing a written or video testimonial on our Site, social media channels, e-mail campaigns, and blog content. Testimonials may be edited for clarity and context, but will only be shared with the user’s prior consent.

Research and Analytics: to analyze how you interact with the Service; to monitor and analyze usage and activity trends; and for other research, analytical, and statistical purposes.

Protecting Rights and Interests: to protect the safety, rights, property, or security of RealSynch, any third party, or the general public; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop any activity that RealSynch, in its sole discretion, may consider to be or pose a risk of being an illegal, unethical, or legally actionable activity; to use as evidence in litigation; and to enforce this Privacy Policy or the terms of any agreement between you and RealSynch, including (without limitation) our Website Terms of Use and our Terms of Service.

Legal Compliance: to comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.

Other Purposes: to fulfill any other purpose for which you provide the information, in any other way we may describe when you provide the information, and for any other purpose with your consent.

How We Disclose or Share Your Information and Legal Bases for Processing

We may disclose certain of the information about you that we collect from you, including Personal Information in some instances, in the manner described below. Our legal basis for collecting and using your Personal Information as described in this Privacy Policy will depend on the Personal Information concerned and the specific context in which we collect it. In general, we collect and process your Personal Information on one or more of the bases described below:

Affiliates: We may disclose your information to current or future affiliates or subsidiaries for research, marketing, and any other purpose consistent with this Policy.

Provisions and Improvements to the Service: We may disclose your information as necessary to provide and improve the Service, including to analyze Site and Platform usage and user behavior in order to enhance Site and Platform functionality, content relevance, and user experience; 
to troubleshoot technical issues; to secure the Site and Platform and prevent misuse or fraud; and to generate aggregated reports and performance metrics for internal business use and service improvements.

To comply with a contractual obligation: We may disclose your Personal Information to others in order to comply with a contractual obligation to you—for example, using your personal details where you have asked us to do something before making a purchase, such as providing you with a quote. We will advise you upon collection whether the provision of your Personal Information is mandatory and of the possible consequences if you do not provide us with that information.

Third-Party Service Providers: We may disclose your information to our vendors, service providers, agents, or others who perform functions on our behalf in order for us to provide the Services. (For more information, see “Payment Processing”, “Third-Party Analytics” and “Other Third-Party Sites and Services” below). For example, we may disclose your Personal Information where we have obtained your consent to process the Personal Information for certain activities (such as the use of cookies for online tracking and analysis). You are free to withdraw your consent at any time by sending us an e-mail at privacy@realsynch.com, indicating your intent to withdraw your consent. If you withdraw your consent, it will not affect the lawfulness of any processing based on your consent before you withdrew it. Where applicable, we may ask for your consent to processing at the point where you provide your Personal Information. Please be aware, however, that certain withdrawals may result in our inability to provide you with the Service.

To comply with a contractual obligation: for example, using your personal details where you have asked us to do something before making a purchase, such as providing you with a quote. We will advise you upon collection whether the provision of your Personal Information is mandatory and of the possible consequences if you do not provide us with that information.

Business Transfers: We may disclose your information to another entity in connection with, including during negotiations of, an acquisition or merger, sale or transfer of a business unit or assets, bankruptcy proceeding, or as part of any other similar business transfer.

Protecting Rights and Interests: We may disclose your information if we believe the disclosure is necessary to protect the safety, rights, property, or security of RealSynch, our customers, or others; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop any activity that RealSynch, in its sole discretion, may consider to be or pose a risk of being an illegal, unethical, or legally actionable activity; to use as evidence in litigation; and to enforce this Policy or the terms of any agreement between you and RealSynch, including (without limitation) our Website Terms of Use and our Terms of Service.

Legal Compliance: We may disclose your information to comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; in response to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a government official.

Aggregated and Anonymized Information: We may disclose your information (including without limitation your Personal Information) for marketing, advertising, research, compliance, or other purposes, but we will ensure that any personally identifiable information we collect from you is first aggregated, anonymized, or otherwise de-identified.

Other Purposes: We may disclose your Personal Information in order to fulfill the purpose for which you provided it, for any other purpose disclosed by us when you provide the information, and with your consent.

Retention of Your Personal Information

We will retain your Personal Information as necessary in connection with the purposes described in this Privacy Policy, for as long as your customer account is active and for a reasonable period of time thereafter as necessary to provide you with the Service, and in accordance with RealSynch’s retention policies and applicable law. We will not retain your Personal Information after you have requested deletion and the time period for deleting such information, as provided in this Privacy Policy, has passed. Third-Party Services

Payment Processing

In order to process payments from you, we use a third-party, PCI-compliant third-party service to process all payments and bank transfers. This information is used to process single payments and to automatically process future recurring payments, and is not stored on our servers. Our third-party payment processors are bound by contractual obligations to keep such Personal Information confidential and use it only for the purposes for which we disclose it to them. We are not responsible for any third-party payment processor’s use of the Personal Information they collect in connection with your financial transactions made via the Site or through a payment link that we provide to you.

Stripe: We use Stripe to process payments of fees due for the Services you may engage us to provide. For information regarding Stripe’s payment processing procedures and privacy and security practices, please see Stripe’s Link Account Terms and Privacy Policy. You are responsible for compliance with these terms, as applicable to you, and any other terms of a third-party processor that we may engage in the future, provided that we notify you of that change in advance, whether directly or by means of requiring you to accept such third-party terms in connection with making or receiving any payment of fees to us.

Third-Party Analytics

We use third-party analytics service providers, such as Google Analytics, Meta Pixel, Ghost Marketing, Pixel, and Sentry.io, in order to evaluate your use of and further improve the Service. We use these tools to help us understand use of, and to improve, the Service, performance, and user experiences. These entities may use cookies and other tracking technologies, such as web beacons or local storage objects, in order to perform their services. You will be able to manage tracking preferences through our Cookie Consent banner. For more information, we our Cookie Policy.

Google Analytics: We use Google Analytics to collect information about your use of the Site. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of the Site. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. This data may include pseudonymous identifiers that can be connected to other data that we have about you.

You can opt-out of making your activity on the Service made available to Google Analytics by installing the Google Analytics opt-out browser add-on available at https://tools.google.com/dlpage/gaoptout. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about website visits activity. For more information about Google’s privacy practices with respect to your information, please see “How Google Uses Information from Sites or Apps that Use our Services”. By continuing to use the Service, you agree and consent to our implementation and features of Google Analytics that we use.

The Ghost Marketing: We use The Ghost Marketing to collect and analyze web traffic information and personal data about users of the Site and Platform to provide tailored content and marketing. This information includes Personal Information such as your name, address, contact information, age, browser information, browsing history, IP address, and other websites you visit. The Ghost Marketing stores this information so that we and they may provide services to you. By continuing to use the Service, you agree and consent to our implementation and features of The Ghost Marketing that we use.

Interest-Based Advertising

We may use third-party advertising and marketing services, such as The Ghost Marketing, in order to deliver advertising about our Service on other websites and applications that you use. The ads may be based on things we know about you, like your usage data and system data, and things that these ad service providers know about you based on their tracking data. The ads can be based on your recent activity or activity over time and across other sites and services and may be tailored to your interests.

Depending on the types of advertising services we use, they may place cookies or other tracking technologies on your computer, phone, or other device to collect data about your use of our Services, and may access those tracking technologies in order to serve these tailored advertisements to you. To help deliver tailored advertising, we may provide these service providers with a hashed, anonymized version of your email address (in a non-human-readable form) and content that you share publicly on the Service.

Other Third-Party Sites and Services

The RealSynch Service may be provided through or utilize features (such as voice controls) operated by third-party platforms, or contain links to sites operated by third parties whose policies regarding the handling of information may differ from ours. For example, you may be able to access the RealSynch service through platforms such as Google and Facebook. These websites and platforms have separate and independent privacy or data policies, privacy statements, notices and terms of use, which we recommend you read carefully. In addition, you may encounter third-party applications that interact with the RealSynch Platform. We are not responsible for the information practices of such third parties.

Data Security

We have implemented reasonable data security measures in order to protect against disclosure of the Personal Information we collect from or about you. No data security measures can guarantee 100% security, however, and you should take measures to protect your devices against unwanted access when visiting our Site or transmitting data or information to us. RealSynch is not responsible for any lost, stolen, or compromised data or information that may result through your access to the Site or your electronic transmission of that data or information to us.

Your Consent and Opt-Out Choices

At RealSynch, we want to ensure that you are fully aware of all of your choices regarding the information we collect about you. You are entitled to the following choices.

Opting out of E-mail Communications

You may opt out of receiving e-mail communications from RealSynch at any time by clicking on the “Unsubscribe” link included in the footer of the e-mail or by e-mailing us at privacy@realsynch.com. Please note that it may take up to ten (10) business days for us to process opt-out requests. If you opt out of receiving e-mails, however, we may still send you e-mails about your account or the Services we provide to you under an agreement with you.

Text/SMS Message Consent and Opt-Out

If you choose, you can provide your mobile phone number to receive text message alerts and notifications and other information related to the Service. You agree that, by providing your mobile phone number you expressly consent to receive automated text messages from us to the mobile phone number provided. Messaging and data rates for your mobile service carrier may apply and you should therefore check the rates of your mobile carrier prior to consenting to this service. You can opt out from further text communications at any time by texting STOP to the SMS number that we used to contact you.

We may share your mobile phone number with service providers with whom we contract to assist us with the above activities, but we will not share your mobile phone number with third parties for their own marketing purposes without your consent. Text messages are distributed via third-party mobile network providers and, therefore, we cannot control certain factors relating to message delivery. Depending on the recipient's mobile carrier, it may not be possible to transmit the text message to the recipient successfully; nor is content available on all carriers. We do not claim or guarantee availability or performance of this service, including liability for transmission delays or message failures.

Your State Privacy Rights

Rights of California Residents

The California Consumer Privacy Act (CCPA) provides California residents with specific rights regarding their Personal Information. The information provided in this section is in addition to the other information set out in this Privacy Policy.

CCPA Personal Information We Collect

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“CCPA Personal Information”). We have collected the following categories of CCPA Personal Information from consumers within the last twelve (12) months:

  • Identifiers: “Identifiers” covers a broad range of information, including things like name, email address, postal address, telephone number, and IP address. We collect some CCPA Personal Information that falls into this category. For example, for streaming subscribers we collect their e-mail address and payment information (as further described in this Privacy Policy). We collect IP addresses, identifiers from the devices you use to access the Site or connect to the Service, and characteristics about the networks you use when you connect to our service online. These types of identifiers are connected to your RealSynch account. There are also identifiers we use for purposes like advertising (resettable device identifiers, third-party advertising cookies on our website) that we do not associate with your account, but that can be used to reach you with promotional messages on other websites and applications.
  • Characteristics of protected classifications under California or federal law: Protected classifications under California or federal law include a wide range of information, including race, sex, and marital status. We will collect this sort of information about you only if you choose to participate in our optional research surveys, or other research activity such as an in-person interview or panel. We do not collect this information when you register for an account to access and use the Platform. 
  • Commercial information: This includes information about products or services you have considered purchasing, obtained or purchased in connection with your use of our Service.
  • Internet or other electronic network activity information:  Our streaming services are online services, so we collect CCPA Personal Information in this category, like your interactions with our service.
  • Geolocation data: Our streaming applications don’t collect precise geolocation data from GPS sensors. However, we do collect IP addresses from which we can determine your general location.
  • Audio, electronic, visual, thermal, olfactory or similar information: We may collect photos, audio and/or video of you in certain circumstances. For example, if you contact customer service, we may record the call (voice recording).
  • Inference data: We have a recommendations system that does its best to predict what you’ll be in the mood to watch when you log in. However, we do not have a list in our recommendation systems that attaches socio-demographic information to you. The inferences we make about your use of our Platform is what you actually choose to watch.

Use of CCPA Personal Information

We use the CCPA Personal Information we collect for the purposes stated above in the “How We Use the Information We Collect”section of this Privacy Policy.

Your Rights Under the CCPA

If you are a California resident, you have the following rights under the CCPA, in addition to your rights under federal law and as otherwise stated in this Privacy Policy.

  • You have the right to request that we disclose: the categories and specific pieces of CCPA Personal Information have been collected about you; the categories of sources from which CCPA Personal Information are collected; our business or commercial purpose for collecting, using, or disclosing CCPA Personal Information; the categories of third parties with whom we share CCPA Personal Information; the categories of CCPA Personal Information we have disclosed about you for a business purpose. We do not sell Personal Information.
  • You have the right to receive a copy of the specific CCPA Personal Information we have collected about you.
  • You have a right to deletion of your CCPA Personal Information, subject to certain exceptions under the CCPA.
  • You have a right not to receive discriminatory treatment for exercising any of your CCPA rights.

Deletion Requests

Generally, the information that we collect about you is stored for only as long as is necessary in order to serve the purpose of that collection, as described in this Privacy Policy. You have the right to request that we delete any of the CCPA Personal Information that we have collected from you and retained. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your CCPA Personal Information from our records, unless an exception applies.

We may deny a request to delete certain of your CCPA Personal Information where it is necessary for us or our service providers to retain the information for a valid business or legal purpose. For example, data may need to be retained in order to:

  • complete a transaction for which we collected the Personal Information;
  • track consumer complaints or service issues;
  • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity;
  • comply with a legal obligation; or
  • enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

Submitting a Request

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a request related to your CCPA Personal Information. You may also make a verifiable consumer request on behalf of your minor child. The verifiable consumer request must provide sufficient information that allows us to reasonably verify that you are either the person about whom the CCPA Personal Information relates or an authorized agent of a California resident who wishes to make a request. You may only make a request to access or delete your CCPA Personal Information up to two times within any 12month period. To submit your request, please e-mail us at support@realsynch.com.

We may not be able to respond to your request or provide you with CCPA Personal Information if we cannot verify your identity or authority to make the request and confirm that the Personal Information requested to be deleted relates to you. We will ask you for the e-mail information that you used to interact with us or to purchase a Subscription from us, only in order to help verify your identity or authority to make the request and confirm that your CCPA Personal Information is in our system. Information provided to us in connection with such a request will be used only for purposes of responding to that request.

If you do not own a RealSynch account, we may not be able to respond to requests to exercise rights under CCPA, including the right to access or delete CCPA Personal Information. Because we only collect limited information about individuals without an account, we are unable to verify requests from non-accountholders to the standard required by the CCPA.

Timing of Our Response

We will endeavor to respond to each verified consumer request within 45 days. If we require more time, we will inform you of the reason and extension in writing. We do not charge a fee to process or respond to a verified consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will provide explanation and a cost estimate prior to completing the request.

Non-Discrimination

We will not discriminate against you for exercising any of your rights under the CCPA.

Do Not Track Disclosure

Under California law, website and online service operators are required to disclose how they respond to web browser “do not track” signals. RealSynch does not currently take actions to respond to Do Not Track signals, as a uniform standard for such response has not yet been established.

Similarly, California law requires website operators to disclose whether third parties may collect Personal Information about their users’ online activities over time and across different sites when the users use the operator’s website. We do not knowingly permit any third parties to collect any Personal Information from our Site or the Platform other than as expressly described in this Privacy Policy.

Changes to this Privacy Policy

This Privacy Policy is current as of the “Last Updated” date set forth above. We may change this Privacy Policy from time to time, so please be sure to check back periodically. We will post any changes to this Privacy Policy, including any material changes, to the Site and the App. By continuing to access the Site, or to provide information and data to us in connection with your access to and use of the Service, after any such changes have been posted to the Site or on the Platform, as applicable, you are indicating that you understand and agree to the terms of this Privacy Policy, as modified.
